LOS ANGELES - A judge has dismissed part of a $2 million lawsuit by Beach Boy Mike Love that claims ex-bandmate Al Jardine illegally used the name of the surf-music kings.

Superior Court Judge James R. Dunn threw out claims of breach of contract and breach of fiduciary duty Wednesday but gave Love's lawyer a chance to amend the case before it goes to trial Nov. 6.

The lawsuit claims that Love, 65, is the only person legally allowed to perform under the name "Beach Boys," but Jardine, 64, had toured with "knockoff bands" using names such as "Beach Boys Family & Friends."

In 2001, Jardine filed a $4 million lawsuit against Love and the Beach Boys' Brother Records Inc., alleging Love had excluded him from concerts that year. The complaint was eventually dismissed.

Love and Brother Records sued Jardine in 2003.

Love formed the Beach Boys in Hawthorne in 1961 with Brian Wilson, Wilson's brothers Carl and Dennis, and Jardine. They went on to record hits such as "Good Vibrations," "Wouldn't It Be Nice" and "California Girls."

Dennis Wilson died in 1983 and Carl Wilson died in 1998.

Does anyone know what started the rift between Mike and Al to lead to seperate touring in the first place? Or is it just something only the two of them know behind closed doors? Seems as though it occurred after Carl died.

Rumor has it that the rift was due to a power struggle between the two over the direction the touring "Beach Boys" should take. Al wanted to get away from the "oldies jukebox" method that Mike preferred, while Mike wanted to maintain the status quo.

Reading this news item, it made me think of the old adage: "He who lives by the sword, dies by the sword." In regards to Mike, is it possible to be sued to death?

Shortly after Carl's death (and because of it), Al quit the touring band. After he calmed down, he decided he wanted to re-join the band but was shut down by Mike "the ice-cream truck" Love. In the wake of Carl's death, Mike, Bruce and David Marks chose to tour as America's Band but found it hard to get gigs, so went back to using the Beach Boys name. At the same time, Al started his Beach Boys, Family and Friends band. It was at this time that Mike started his crusade to ensure that there was only one band using the name the Beach Boys. And the rest, as they say, is one lawsuit after another. So much for all the good, good, good vibrations.
